Indiana Child Killer Gets Free Sex Reassignment Surgery Paid For By Taxpayers

Taxpayers in Indiana are being forced to foot the bill for gender reassignment surgery for a convicted baby killer. The federal court ruling has ignited a fierce constitutional battle pitting transgender rights against state laws explicitly prohibiting such use of public funds.

At a glance:

• Federal judge orders Indiana to provide sex reassignment surgery to transgender inmate Autumn Cordellioné, who was convicted of killing her 11-month-old stepdaughter

• Indiana state law explicitly prohibits taxpayer funding for gender reassignment surgeries for inmates

• ACLU lawsuit claims denial of surgery constitutes “cruel and unusual punishment” under Eighth Amendment

• Court rejected prison psychologist’s evaluation that Cordellioné was unsuitable for surgery due to antisocial and borderline personality disorders

• Indiana Attorney General Todd Rokita is fighting the ruling, asserting taxpayers shouldn’t fund “expensive and controversial sex-change operations” for convicted murderers

Court Overrides State Law, Forces Taxpayer-Funded Surgery

Federal District Judge Richard Young has ordered the Indiana Department of Correction to arrange sex reassignment surgery for transgender inmate Autumn Cordellioné “at the earliest opportunity.” Cordellioné, born Jonathan Richardson, is currently serving a 55-year sentence after being convicted in 2001 for the strangulation death of his then-wife’s 11-month-old daughter.

The ruling directly contradicts Indiana state law that specifically prohibits taxpayer funding for gender reassignment surgeries for prison inmates. Judge Young’s preliminary injunction will be renewed every 90 days until the surgery is provided, essentially creating a judicial mandate that overrides legislation passed by elected representatives.

Indiana Attorney General Todd Rokita has strongly opposed the ruling, defending the state’s right to determine appropriate use of taxpayer funds. “Convicted murderers don’t get to demand that taxpayers foot the bill for expensive and controversial sex-change operations,” Rokita stated, highlighting the core conflict between activist judicial rulings and state sovereignty.

Expert Evaluation Rejected by Court

Prison psychologist Dr. Kelsey Beers conducted an evaluation of Cordellioné and determined the inmate was not a suitable candidate for gender reassignment surgery. Her professional assessment attributed Cordellioné’s distress to antisocial and borderline personality disorders rather than genuine gender dysphoria.

“Dr. Beers concluded that Ms. Cordellione was not a proper candidate for surgery because of her conclusion that Ms. Cordellione doesn’t have gender dysphoria at all. Rather, Dr. Beers concluded that Ms. Cordellione’s purported distress is actually a manifestation of her… ‘established pattern of attention-seeking behavior’.”

Despite this expert medical evaluation, Judge Young dismissed the findings, stating “the court finds that Dr. Beers’ report does not present a significant factual development that would cause it to reconsider its grant of injunctive relief as to Ms. Cordellioné’s Eighth Amendment claim.” This judicial override of medical expertise raises serious questions about who should determine appropriate medical care for inmates.

Growing Trend of Taxpayer-Funded Transgender Surgeries

The Indiana case follows a similar pattern established in other states where courts have mandated taxpayer-funded gender surgeries for inmates. Idaho was previously ordered to pay over $2.5 million in legal fees to transgender inmate Adree Edmo, who was serving time for sexually abusing a minor.

There are currently over 5,000 transgender inmates in US prisons, with California alone spending $4 million on sex-change surgeries for inmates from 2017 to 2023. The escalating costs and constitutional conflicts highlight growing tensions between progressive judicial rulings and state laws designed to protect taxpayer interests.

Cordellioné began gender transitioning in 2020, taking feminizing hormones and testosterone blockers while incarcerated. The prison has already provided accommodations including female clothing and makeup, but the question remains whether taxpayers should be forced to fund complete surgical transitions for convicted violent offenders.
