Alan Dershowitz Says Trump Won’t Be Indicted

(FiveNation.com)- Former President Donald Trump has emerged as the big winner, according to Alan Dershowitz, a professor emeritus at Harvard Law School, following claims that classified documents were discovered at Vice President Joe Biden’s University of Pennsylvania office in Washington, D.C.

According to reports, Attorney General Merrick Garland announced a Special Counsel had been appointed to look into the records found at the Penn Biden Center and the president’s Delaware home.

According to Biden’s counsel, a third group of documents was found at the president’s house on Thursday.

According to Dershowitz, who joined “The Record with Greta Van Susteren,”  former President Trump may no longer be indicted for records taken at Mar-a-Lago. This is because a similar incident involving Biden occurred at Penn Biden Center while he was vice president under President Barack Obama.

Dershowitz explained that the idea of prosecuting the one who is running against the incumbent and not going after the one who is the incumbent wouldn’t pass the impartial principles test. Two people are running for president against each other, and both have allegedly mishandled classified data. If there had been any chance Trump could have been indicted for mishandling sensitive material at Mar-a-Lago, that has utterly disappeared today.

Dershowitz is confident that there will not be a criminal prosecution against Donald Trump, but he warned that prosecutions relating to Trump’s participation in the Capitol riot on January 6, 2021, could yet happen.

Dershowitz thinks the Mar-a-Lago situation has been topped by the discoveries regarding Biden. He added that he didn’t think either Trump or Biden wanted to jeopardize national security.

Dershowitz modified his “Clinton-Berger” test, which he devised in response to the Justice Department’s decision not to bring charges against former Secretary of State Hillary Clinton and former National Security Advisor Sandy Berger for possessing sensitive information.

The law expert explained the investigation of Trump needs to pass the Clinton-Berger test and now the Clinton-Berger-Biden test.  It has to be a lot worse than what the three Democrats did.
